The appellant, Mr. Ali Haider, filed the instant service appeal with the following prayer:
"It is therefore humbly prayed that by accepting the instant appeal, the impugned advertisement dated 31st July 2024 may graciously be declared null and void to the extent of cases reflected at S. Nos. 138 to 140, and the process of induction against said posts may also be ordered null and void to the extent of the position of the appellant. Respondents may graciously further be directed to consider the appellant for promotion against the post concerned in light of the rules in the interest of justice, law, and equity."
Learned counsel for the appellant argued that the appellant is working as Deputy DEO at the DDE Office, Gilgit, since his posting to the said place. He submitted that the existing rules of the Education Department GB provide a method of division of vacancies in order to recruit officials through direct induction and by promotion and transfer. He further submitted that the posts of Deputy Director Education/Assistant Director Education, District Inspector of Schools/Deputy Inspector of Schools, and Deputy Education Officer are to be filled by promotion at the ratio of 75% from among the eligible staff, whereas 25% is allocated for direct induction.
The posts of District Inspector of Schools, Assistant District Inspectors of Schools, Assistant Education Officers, Assistant Inspectors of Schools, and Assistant Director Education (Schools) are to be filled through direct induction at the rate of 50% and by promotion among senior officers at the rate of 50%.

درخواست گزار جناب علی حیدر نے فوری سروس اپیل درج کرائی جس میں درج ذیل درخواست کی گئی:
"یہ مودبانہ طور پر استدعا ہے کہ درخواست قبول کرتے ہوئے 31 جولائی 2024 کا متنازعہ اشتہار جزوی طور پر کالعدم اور باطل قرار دیا جائے جیسا کہ نمبر 138 سے 140 میں ذکر کردہ معاملات کے لحاظ سے اور ان عہدوں پر بھرتی کا عمل بھی کالعدم قرار دیا جائے اور درخواست گزار کے حق میں ان کے عہدے کے لحاظ سے فیصلہ دیا جائے۔ مزید برآں، مدعا علیہان کو ہدایت کی جائے کہ درخواست گزار کو مذکورہ عہدے پر قواعد و ضوابط اور انصاف کے اصولوں کے تحت ترقی کے لیے غور کریں۔"
درخواست گزار کے وکیل نے دلائل دیے کہ درخواست گزار ڈپٹی ڈی ای او کے طور پر ڈی ڈی ای آفس گلگت میں خدمات انجام دے رہے ہیں۔ انہوں نے یہ بھی کہا کہ محکمہ تعلیم جی بی کے موجودہ قواعد کے مطابق افسران کی بھرتی کا طریقہ کار براہ راست بھرتی، ترقی، اور تبادلے کے ذریعے کیا جاتا ہے۔
مزید کہا گیا کہ ڈپٹی ڈائریکٹر ایجوکیشن، اسسٹنٹ ڈائریکٹر ایجوکیشن، ڈسٹرکٹ انسپکٹر آف اسکولز/ڈپٹی انسپکٹر آف اسکولز اور ڈپٹی ایجوکیشن آفیسر کے عہدے 75% اہل امیدواروں کی ترقی کے ذریعے اور 25% براہ راست بھرتی کے ذریعے پُر کیے جاتے ہیں۔
ڈسٹرکٹ انسپکٹر آف اسکولز، اسسٹنٹ ڈسٹرکٹ انسپکٹرز آف اسکولز، اسسٹنٹ ایجوکیشن آفیسرز، اور اسسٹنٹ ڈائریکٹر اسکولز کے عہدے 50% براہ راست بھرتی اور 50% ترقی کے ذریعے پُر کیے جاتے ہیں۔
